United Kingdom Ancestral Connections

Q.158 Is there any difference if the applicant has ancestral connections with the United Kingdom?

A. Yes. A Commonwealth citizen only (not any of the other types of citizen) who wishes to come to the United Kingdom on grounds of ancestral connections can do so if he applies when he is 17 years old or over (re Leahy no. 7981). Ancestral connections mean that the applicant has one of his grandparents born in the United Kingdom and islands. He should be able to work (not as a working holidaymaker but generally) and be seeking employment in the United Kingdom. He does not need a work permit. He must also be able to accommodate and maintain himself and any dependants adequately without recourse to public funds. He must apply abroad for an entry clearance in this capacity before coming and must show evidence of meeting all the requirements mentioned. It may, however, be possible to switch in the United Kingdom to this category if all the requirements are present. Ancestral connection by a Commonwealth citizen does not apply to an illegitimate child claiming through paternal grandparents. The applicant must produce evidence of his grandparent's birth certificate, his parent's birth certificate, and his own birth certificate (all documents must be originals).

Q.159 What countries are referred to as the United Kingdom and islands?

A. The United Kingdom and islands for this purpose are comprised of England, Wales, Scotland, Northern Ireland and the Isle of Man and the Channel Islands. In addition, what is now the Republic of Ireland will be considered if the grandparent was born there before 31 March 1922.

Q.160 How long will someone with ancestral connections be granted leave to stay?

A. He will be granted leave to stay for a period up to, but not exceeding four years. After this period he can obtain indefinite leave to remain if he applies for such leave before the end of the four years. He must have spent a continuous period of the four years of his leave in the United Kingdom in employment and must have satisfied all the other requirements.

Q.161. Can such a person bring his spouse and children with him or to join him?

A. Yes. He must actually be married to the spouse and they must intend to live together as man and wife. He must satisfy the requirements for accommodation and maintenance as mentioned and the accommodation must be exclusively for their use. The spouse will be allowed for the same period as the applicant and must show her intention of leaving at the end of such period granted. An entry clearance will be necessary before the spouse can accompany or join the applicant. Where indefinite leave to remain is applied for by the spouse with such United Kingdom ancestral connection, he can also apply for his spouse to remain indefinitely.

His children can also accompany or join him if such children are under 18 years. Both parents must have been admitted or be in the process of being admitted
