Wali Khan was accused of ordering the death of Mohammad Sherpao and was brought to trial after an extended period of incarceration. In his defense Wali Khan insisted that Bhutto had planned Sherpao’s death in order to justify the destruction of the NAP. It was pointed out that the security police who are authorized to be at the minister’s side in such public affairs absented themselves from the dais. Moreover, the device which took Sherpao’s life was judged to be far too sophisticated for the simple Pathans. In previous bombings on the Frontier none showed the instrumentation or the precision that this one displayed. Indeed, many devices were so clumsily made that they often went off before they could be placed, killing or maiming the would-be terrorists. The case was still being tried when Bhutto was overthrown in July 1977. Whatever issues it raised were left unanswered when the new martial law regime ordered the proceedings closed and Wali Khan unconditionally released. Like the Bengali, Mujibur Rahman, who had been freed from a court proceeding some years before, Wali Khan returned to the North West Frontier and was greeted excitedly by his compatriots.

Bhutto’s subsequent arrest by the military authorities, his own trial, conviction and execution, was not mourned on the Frontier. The NAP was not re-established but surfaced this time in the form of the National Democratic Party. The government of General Zia-ul-Haq pledged non-interference in NWFP affairs in return for Pathan loyalty and Wali Khan agreed to accept the offer so long as it was deemed genuine. It was also at this time that political conditions deteriorated in Afghanistan, caused by the Marxist takeover of the Kabul government, and thousands of Afghan refugees sought refuge across the Pakistan frontier. The Kabul government accused Pakistan of arming and training as well as providing sanctuary for religiously inspired Afghan insurgents and tensions on the frontier were never more severe. In these circumstances, the intentions of Wali Khan and his political movement, which had by now passed through numerous transitions, were destined to become more clear.
