10. How to Navigate the Legal Maze

HOMEOWNERS FREQUENTLY become hysterical and/or enraged upon receiving a warning letter from the association attorney. It feels like a firecracker exploding in one’s brain. Few understand how to respond or whether to hire an attorney to assist in their case. Many ignore the letter. Others reply with verbose content, entreaties and threats.

As discussed earlier, the homeowner is typically given a thirty-day window to comply with the Board’s initial warning letter. If the owner does not comply in that time frame and notify the Board of such compliance, a legal warning letter will follow. You are then typically granted an additional fourteen days to comply with the legal warning letter.

It is essential that you or your attorney acknowledge receipt of the legal letter within the time specified. If the violation is something you wish to clear up quickly, then respond immediately and always by certified mail, with return receipt requested. The one thing you should not do is wait until the last moment to seek legal advice.

And beware! The association is billing you for the attorney’s time in issuing that letter. Therefore, you can find yourself in a bizarre situation.

1) You comply with the Board’s request but fail to notify the Board and therefore receive a legal warning letter from the association attorney.
