1 One significant exception to this is Rajagopal, who essentially argues that the ‘instrument effects’ of the attempt to institutionalise a New International Economic Order were to deradicalise the claim and to cause a proliferation of institutions in the areas of the Third World demands. This, in turn, bolstered the operation of ‘hegemonic’ international law. He uses the term ‘instrument effects’ in the Foucauldian sense, which he borrows in the context of development from James Ferguson. I am broadly in agreement with Rajagopal. Our differences lie mostly in emphasis, his being sociological (particularly the study of social movements) and mine being jurisprudential (particularly my detailed deconstruction of doctrinal debates).
