Restorative Justice Techniques

In addition to the more conventional interventions, practices involving restorative justice techniques have also begun to gain ground in the last few years, although arguably they still largely exist on the fringes of the criminal justice system, despite having deep historical roots (see Johnstone 2002). While there has been some debate regarding whether it is a set of principles or an actual practice (see Daly 2009), restorative justice can be defined as ‘a process whereby all the parties with a stake in a particular offence come together to resolve collectively how to deal with the aftermath of the offence and its implications for the future’ (Marshall 1999: 238). Key values that underpin all restorative approaches include:

• Inclusivity – where the interests of the victim and others are brought more fully into the process of dealing with the offender.

• A balancing of interests – where an appropriate balance between all stake holders in the process is sought.

• Consensual non-coercive participation and decision making.

• Problem-solving orientation – where the focus is on reintegrating the offender back into the community with the focus placed on forward looking and the prevention of reoffending.
