Feist did not hold it unconstitutional to afford federal protection to an unoriginal work. Rather, it merely held that no statute promulgated under the Copyright Clause could protect an unoriginal work. Thus, if Congress deems it appropriate, Congress has the power to enact legislation, not promulgated under the Copyright Clause, to protect unoriginal aspects of databases. Some commentators are suggesting that Congress should do precisely that (under the Commerce Clause), and a number of specific proposals along that line have been made.
