61 It is a surprising fact that, as recently as 1995, some Supreme Court justices in the United States still insisted on interpreting the subject ‘We the People’, cited in Article 1, paragraph 1, of the United States Constitution (notwithstanding the grammatical singular), as referring to the aggregate of ‘peoples’ of the component states and not to the federal people. Nevertheless, although this is indeed a testimony to the stubbornness of old loyalties, it is not an argument against the conceptual necessity of differentiating between the level at which a political community is constituted and the levels constituted within it; on this case, see Schönberger, ‘Die Europäische Union als Bund’, pp. 81ff.
