Note

1. 338 U.S. 801.

Table 5-1

aOnly those justices who had departed the Court by early 2021 are included. For justices who served as associate and chief justice, the table reflects their total time of service.

bLength of tenure is measured from the date of oath of office to the date of departure. Data are presented to the nearest completed month. Ties are broken first by the number of days served beyond the last completed month. Using the date of Senate confirmation or the date of receiving the commission as the beginning of the justices’ tenures would lead to slightly different results. Especially in the earlier historical periods a newly selected judge sometimes would not arrive in Washington to take the oath of office and begin sitting on the Court until several months after being confirmed. The delay was due to the Court’s practice of only sitting a few months out of every year and the often inefficient travel between an appointee’s home state and the District of Columbia.
