WhatsApp can process all the personal contact information from the userâs phone, irrespective of whether those contacts have the app or not. Returning to that construction firm, a team leader might have the details of several hundred clients and suppliers in their phone and communicate with some of those via WhatsApp. All those clients that donât have WhatsApp would now have their personal details stored on the WhatsApp servers. With many people within the firm using WhatsApp for external and internal communication, the firm is now at risk of a GDPR incident and the potential penalties that come with that. Itâs worth reiterating the size of those financial penalties againâeither a maximum fine of â¬20 million or four percent of turnover, whichever is greater. Neither option is an attractive option for any organization.
The scale of the potential risk is huge. Research from Guild in early 2020 revealed that 41 percent of UK workers use WhatsApp for work purposes, despite it being against WhatsAppâs legal terms of service to use it in ways that involve any non-personal use. This figure rises to 53 percent for those under 45, and in Greater London, 58 percent of workers use WhatsApp for work purposes.48 These figures were pre-coronavirus too, and with a much more distributed workforce now, it is not unreasonable to think that work-based WhatsApp will have increased even further.
Itâs not just GDPR though and itâs not just WhatsApp. Whichever consumer-grade tool an organization uses, it puts that company at risk of breaching the data privacy legislation of whichever country or region it is operational in. The wave of regulatory compliance is not going to stop now, and organizations must manage requirements to the best of their ability, gaining control of workplace communication among frontline workers, or face severe financial consequences.
