“I HAVE NOTHING ELSE TO SAY”

John Foreman glared at me as he exited the lobby of Four Embarcadero Center. “Now you’re accosting people at the office?”

Actually, I waited for you downstairs. “I left messages by email, text, and voicemail. You didn’t return any of them.”

“I’m busy.”

I kept my voice even. “I wanted to let you know that we may need you to testify at César’s prelim next week.”

“You could have emailed me.”

“I did. As a matter of professional courtesy, I also wanted to tell you in person.”

“You’re wasting your time.” He added, with gratuitous snark, “I will testify if you serve me with a valid subpoena, and I determine that I am legally compelled to appear. I will also expect you to compensate me at my hourly rate of nineteen hundred and fifty dollars an hour.”

Ouch. “You know that a subpoena is a court order that requires you to testify. We are under no obligation to compensate you for your time.”

“What on earth do you need me to testify about?”

“That you saw Jerry Henderson, Tyler Benson, Jason Strong, and F.X. Quinn at For Gentlemen Only on Friday night.”

“There were dozens of people at the club on Friday night. You can find somebody else to confirm that information.”

Yes, I could. “It will be more convincing coming from somebody of your stature.”

He rolled his eyes. “I don’t know who killed Chloe Carson.”

“I don’t expect you to testify that you do.”

“I will fulfill my legal obligations.”

“Thank you.” Good to hear—especially since you’re a lawyer. “Did you see Jason Strong?”

“Only on the video that’s gone viral.” He invoked his best “big-firm-lawyer” voice. “If you make the slightest suggestion that I was involved in Ms. Carson’s death, I will sue you and your office for defamation. I have hundreds of extraordinarily aggressive associates at my disposal who would love to impress me by notching a victory against the PD’s Office. It will not enhance the reputation of your office or your ex-wife’s re-election prospects if someone of my reputation in the legal community files a lawsuit. My grunts will bury you in paperwork and make your life miserable for the next five years.”

I’m terrified. “Thank you for bringing that information to my attention, John.”
