In the 1870s and 1880s, Fort Smith was no longer just a distant military outpost on the edge of civilized America. The town had grown into a manufacturing center and remained an important stop along the nation’s trade routes due to its strategic river port location. The railroads, too, were beginning to “track” across the nation, and the trains brought more settlers and businessmen to Fort Smith.

Lawlessness in this important, expanding part of the U.S. would no longer be allowed by the federal government. This new “law and order” required special men to carry it out: a legion of U.S. Marshals to track, arrest, and bring the outlaws to justice; a strong U.S. District Attorney to effectively try the criminals; and three federal judges to sit “in judgment” of those men and women brought before them.

U.S. District Attorney W.H.H. Clayton served a long and distinguished career in the Western District Federal Court. While Clayton served the district as U.S. Attorney, Isaac C. Parker—known to history as “the Hanging Judge”—was appointed to the judgeship of this massive federal district in 1875 by President U.S. Grant.
