What is becoming clear is that voluntary standards and codes are capable of developing âcommand and control statusâ while bypassing Parliament because the courts use accepted standards as evidence of reasonableness or lack of negligence.27 As one author has observed, once these standards become industry benchmarks, they can be endorsed by the courts and develop legal effects that may set lower standards than those that might otherwise be in the public interest.28
In recent years, the potential for evaluative knowledge about how such instruments function has been greatly improved: rapid movement of data, research sharing, and linked discussions are possible. Information sharing among scientists, NGOs, and public servants challenges traditional instruments and government choices at a faster rate and with greater effect than ever before possible. A great deal of this knowledge actually comes from beyond our borders.
