The Constitutionality of the Affordable Care Act

The passage of the Affordable Care Act was filled with drama: the drama of the August 2009 recess, when representatives and senators were attacked by Tea Party opponents of reform; the drama of the Senate’s Christmas Eve vote for the ACA, in which Majority Leader Reid mistakenly voted to oppose the Senate’s bill; the drama of Vice President Biden whispering the famous expletive to President Obama at the signing of the act.

As though this were not enough, the drama continued with 3 days of Supreme Court arguments in March 2012, and then the ultimate drama of June 28, 2012, when the Court ruled. And the drama was further heightened by CNN’s mistake in trying to be the first to report the Court’s decision—but calling it wrong. Their call stopped hearts and sowed confusion for 10 minutes or more until the real facts could be circulated.

Ultimately, the Court ruled that the ACA was constitutional as an application of Congress’s power to tax. It also created a complication for rolling out the Medicaid expansion, limiting the powers the federal government can use to persuade states to adopt certain policies.
