“I would say take another test until you get good agreement between the two tests,” Miss Kirkwood replied. “In other words, I would start again and do another two tests.”

SID SIMONS POSED A POSSIBLE explanation of the .03 difference in Richard Redekop’s two readings.

“If I were to take a glass, and fill it with a substance,” he asked Caroline Kirkwood, “perhaps gin or vodka, and drink it, it would go immediately to my stomach. If I then were to bring up some of the contents of my stomach—if a person is to some degree in shock or demonstrates nausea—and then takes a test on the Borkenstein Breathalyser machine, would the reading be higher, lower, or different than if I had not brought up these stomach contents?”

“If what was brought up from the stomach was alcohol, it could elevate the reading,” replied the witness. “It could give a falsely high reading.”

Harry Rankin’s son-in-law turned to Rankin. “Did Redekop barf before the breathalyser test?” he whispered.

Rankin shrugged. “Who the hell knows!” he muttered.

“And then,” continued Simons, “if the person were to calm down in the next ten or fifteen minutes and blow again, the reading would be appreciably lower? The second blow, if you like, would be air from the lungs and not mixed with stomach contents . . . and that could account for the appreciable difference in the two readings?”

“Yes, it may,” replied the witness.

In further questioning, Miss Kirkwood said that she did not agree with the physical tests—heel-to-toe, picking up coins—that officers use to test degrees of intoxication. “A police officer, seeing an individual for the first time,” she said, “cannot determine whether that individual has an inner ear infection or some other disturbance that prohibits him from performing these tests normally.”
