ANECDOTAL NOTES

As recommended in Chapter 2, be sure to understand your professional liability at the clinical site. Teachers and students are held to the same standards of care that a reasonably prudent person with the same level of education and experience would use in the same or similar circumstances (Lessner as cited in Oermann & Gaberson, 2013). The determination of professional liability can vary from state to state, and the appropriate state board of nursing can provide any specifics you may need. As a general rule, however, teachers are not liable for negligent acts performed by their students if they have done the following:

1.Selected appropriate learning activities based on skills necessary to complete the assignment.

2.Determined that the students have the necessary knowledge and skills to complete the assignment.

3.Provided necessary guidance.

To show that you, the clinical nursing instructor, have in fact complied with these requirements, it is helpful to devise a system for maintaining “anecdotal notes” relating to each student’s performance. These notes are observations of a student’s performance or behavior. See Exhibit 10.1 for an example.
