Before the passage of the Seventeenth Amendment, senators were elected by their state’s legislatures.

When there is a vacancy in the Senate, the governor of the affected state can call for a new election. A governor can also appoint a temporary replacement if given the authority by the state’s legislature.

Senators who were elected before this amendment was enacted are not affected by it until the end of their term.

EIGHTEENTH AMENDMENT

PROHIBITION OF ALCOHOL (1919)

Intoxicating liquors, such as beer and wine, will be forbidden in the United States. They may not be manufactured, transported, or sold. This amendment will take effect one year after its ratification.

Congress and the states may enact laws to enforce this provision.

This amendment will not go into effect unless it is ratified by the states within seven years.
