As our criminal justice system moved away from an emphasis on rehabilitation in sentencing and as sentencing became harsher by degrees, prosecutors gained more control over plea bargaining. How they decided to charge could put tremendous pressure on defendants to plead guilty. What can happen today in courtrooms in the United States can be scandalous. The plea-bargaining pressures on defendants are often extreme. In order to understand the transformation of our criminal justice system away from trials, there is no better way to get an introduction to our plea-bargaining culture than to understand the way a famous metaphor of our criminal justice system has been turned on its head. The metaphor is that of the “gatehouse” and the “mansion.”
