While I was thinking about other chapters for this book, it dawned on me that some of the most important texts of recent years have rarely been read. Am I talking about a little known riveting work of fiction, or maybe an unpublished factual work from a disregarded author? Not quite. Thereâs a scene in one of the later seasons of HBOâs sitcom âSilicon Valleyâ where some of the characters are discussing the terms of service of their new video chat service. One character says he didnât add the terms of service as he forgot and then didnât want to bog users down with legal speak that nobody reads anyway. Another character responds that âeveryone reads the terms of service.â The look of bewilderment on another characterâs face in response to this comment is priceless and all the more amusing as itâs something I think we can all relate to.
Think about how many connected services you use. Online banking, smart phone app stores, email services, messaging apps, social networks, online shopping, streaming services. The list will likely go on and on. Have you read the terms of service (ToS) for any of these connected services that you use? I would bet a lot of money that the vast majority of us would answer in the negative, and, in the interest of full disclosure, I hadnât either until I began thinking about this book. Why is this an issue? Well it means that you donât know what the businesses that offer these services are doing with your information nor what your rights are (or arenât) if things go wrong. The majority of the data practices weâve discussed previously will be enabled by our agreement to the terms of service we sign up for.
You may feel that my reference to these ToS documents as some of the most important works of recent years is a bit of an exaggeration, but I donât believe it is, as these terms govern so much of our information and subsequently our lives when weâre online or on our smartphones. Think about the amount of time you spend on your phone, pretty much everything that youâre interacting with, providing information to, posting pictures on and paying for things through are governed by these documents. Itâs a way of life we donât see in the offline world and reading just one of these documents is truly insightful.
Iâve read a few of these ToS documents and in this chapter will outline many of what I believe are the more surprising points that I think you may not be aware of. These particularly revolve around responsibilities on you and the businesses youâre interacting with, as well as the stipulations around data and ownership. Unsurprisingly, the focus of everything is on providing a more personalised and seamless experience.
