Suffered enough

Narratives in which the offender, suffering under the enormous pressure of caring for a PWD, kills in a moment of hopeless desperation generally culminate in lenient sentences. Essentially, these offenders are portrayed as having ‘suffered enough’ and therefore, as it is put by Barr J in R v Sutton, ‘the need for further punishment is spent’ (2007, [38]). The offender’s history of caring for the victim, often without support or recognition, is framed as a deprivation of their liberty that pre-empted the offence. Further, an unusual reasoning emerges where living with the knowledge of having committed the offence and the subsequent loss of a loved one is treated as sufficient penance. The results are significant, with ‘exceptional’ circumstances being cited to warrant the handing down of suspended sentences in response to what a less ableist society might perceive to be murdered (see, e.g. R v Sutton 2007; R v Dawes 2004; R v Puhle 2013).
