The ECJ is not bound by the doctrine of precedent in the same way as UK courts are. It is always open to the ECJ to depart from its previous decisions where it considers it appropriate to do so. Although it will endeavour to maintain consistency, it has, on occasion, ignored its own previous decisions, as in European Parliament v Council (1990), where it recognised the right of the Parliament to institute an action against the Council.

The Court of Auditors

As its name suggests, it is responsible for providing an external audit of the Community’s finances. It examines the legality, regularity and soundness of the management of all the Community’s revenue and expenditure.

As we have seen, one relatively small aspect of EU law is to do with human rights. The main source of human rights law in Europe, however, is the European Convention on Human Rights and the European Court of Human Rights – they are not part of the EU machinery. We now turn to examine human rights in the next chapter.
