1. THE FUNCTION OF APPROPRIATION
IN ITS legal aspect, the change from simple commodity production to capitalist methods shows as we have seen, above all a highly developed differentiation of property-objects. The old patrimony was a universality of objects of all kind, a universitas rerum with a uniform general method of functioning. As a rule it comprised a piece of land with the buildings appertaining thereto, and an aggregation of means of production, consumption goods, commodities and money. This totality offered to one persona all the means of labour and existence and nearly complete independence; in its legal fate it was undivided. (215) It was transferred as a legal unit to a new persona by settlement inter vivos, (216) and by inheritance mortis causa.
