It was very helpful to Peter to have someone else available to question George Kempton. It is a relevant point for anyone facing a former employee in a tribunal. There is always a risk that personalities will clash and the facts on which a dismissal was made will be obscured by rancour between the parties.
The Verdict
The Chairman brought proceedings to a conclusion, and then said that the Tribunal would announce its decision âimmediately after lunchâ. Thus, Ray, Peter and Jennifer had another stressful hour to wait. Whatever the tribunal members had for lunch, the respondents were certainly left in turmoil. This is mentioned just to emphasize that facing tribunals is a very stressful matter, so be prepared to âface the musicâ if you ever get involved with one.
At least when the verdict came, it did not take long to deliver. The Chairman stated simply that, on the âbalance of probabilitiesâ, they found that George Kempton had been fairly dismissed. They had done so by a majority verdict. One member of the Tribunal had felt that, though Kemptonâs offence was a grave one, he might have been allowed one more warning before he was dismissed.
Jennifer, Ray and Peter had not eaten any lunch. They now went off to a local tea shop for some âcomfort foodâ and a chance to relax before starting on the drive home.
