Nonprofits in State and Local Environments
The local and state environments in which nonprofit managers carry out their duties is challenging to characterize because of the enormous diversity in the types and sizes of nonprofits. Additional diversity is mirrored across states in rules and regulations that nonprofits must comply with. Even within a given state, different statutes may govern a nonprofit, depending on how the nonprofit is formed. In North Carolina, for example, state statutes define nonprofit organizations as either corporations or unincorporated associations. Those formed as corporations are governed by one set of North Carolina statutes while a different statute governs unincorporated associations.
Most of the 30,000 nonprofits in North Carolina are small organizations, with 20 percent with annual budgets greater than $100,000, while two-thirds have budgets of less than $25,000. Most rely on volunteers, part-time employees, or no more than a single full-time employee. Nonprofits that deal with local governments in North Carolina are subject to some laws that regulate governments themselves, but not all. Governments, for example, must comply with public records and open meetings laws, but nonprofits do not have to (Whitaker & Drennan 2007).
Nonprofits are regulated by the State Attorney Generalâs Offices in each state, âarguably not the best agency for charitable oversight but it is what we have right now,â says Alicia Shatteman of the Center for Non-Governmental Organization Leadership and Development at Northern Illinois University. Forming a nonprofit organization in Illinois can be a daunting process (Shatteman 2015). Any charity holding or soliciting funds in Illinois must first register with the Illinois Attorney General, file an Internal Revenue Service application for a tax exemption, and request a state sales tax exemption from the Illinois Department of Revenue.
