Timeshare Lawsuit - $5,000.00

Danielle went to her files and grabbed the timeshare folder. She was writing a response to their venue change motion based on her notes. “Well, this should be something easy to write. Let me pull up the notes I wrote for this case.”

Danielle found her files, complete with her notes on jurisdiction. She also pulled up the legal brief template she had developed for this case. Previously, Danielle created brief templates for all the lawsuits so that she could write each response quickly. The Argument section was the only thing left for her to complete for each case.

Danielle was arguing against the Timeshare’s venue change request for this response. Danielle copied the information from her notes concerning jurisdiction and began tweaking the language to fit her argument. After a few revisions, Danielle believed she had effectively presented her reasons for the case to not change counties.

The Plaintiff believes that the Prince Charles (PC) County Court system is the correct jurisdiction to hear this case. The Plaintiff contends that federal and state laws support the assertion that the PC County Court System is the proper venue for this case. According to federal law 28 U.S.C. § 1391(b), a civil action may be brought in:

a judicial district where any defendant resides if all defendants are residents of the State in which the district is located;
