Development of human rights instruments and promoting their implementation round the world is one of the activities undertaken towards this aim. For the first time in the history of humankind, the human rights instruments gave a hope that the basic needs of every human on the globe would be fully met (Sharma, 1998).
According to the UN (1992b), human rights could be generally defined as those rights that are inherent in our nature and without which we cannot live as human beings. Human rights and fundamental freedoms allow us to fully develop and use our human qualities, our intelligence, our talents, and our spiritual and other needs. They are basic and fundamental for humankindâs increasing demand for a life in which the inherent dignity and worth of each human being receive respect and protection. The denial of human rights and fundamental freedoms is not only an individual and personal tragedy, but also creates conditions of social and political unrest, sowing the seeds of violence and conflict within and between societies and nations. The ideology of human rights comprises of values of human dignity drawn from secular humanism, freedom drawn from liberalism, participation drawn from democracy, and equality drawn from socialism (UN, 1992b).
This chapter focuses on the International Human Rights Law and its influence on the policy approach for rights-based development. It first discusses the types of international human rights instruments, human rights principles, obligations which signatory states are bound to respect, critique of human rights, and the human rights movements. The history, importance, and policy approach for development that is based in these rights is then reviewed with its emphasis that development is not a charity but legally enforceable.
