INVESTIGATING REPORTS

Interagency reporting. Some states require that cases involving serious harm be reported to a district attorney for possible criminal prosecution and/or that social workers may contact a law enforcement agency and request assistance with the investigation.

Conduct of the investigation Statutes specify when the investigation is to begin (e.g., within twenty-four hours of receipt of a report), and who conducts the investigation (e.g., child protective service and/or law enforcement personnel). Procedural requirements may be specified (e.g., a mandatory evaluation of the child’s environment and a determination of risk to a children if they continue to remain in the home).

Protective custody. Specifies who is allowed to take a child into custody without parental consent and the conditions that justify such action. States limit the amount of time that a child may be held in protective custody (e.g., twenty-four to forty-eight hours, for instance) before a petition must be filed with the court.

X-rays, photographs, emergency medical care. Permits taking x-rays and/or photographs of a child with and without parental consent when needed for emergency medical treatment.
