The virtues of Waldron’s book can be seen in the way in which he deals with the question of whether it is legitimate to prohibit certain forms of speech only. Again, this is a distinction which is grounded much more obviously in EU and UK rather than US law. The distinction between these two approaches can be seen by comparing the language of the First Amendment to that of Article 10 of the European Convention on Human Rights. The former, on its face, appears to prohibit any restriction on free speech at all:

Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
